Terms of service

These terms are an agreement between you and us. They apply when you use the Yonto apps, the yonto.app website, or the account site at account.yonto.app, and when you buy Yonto Pro. By using any of them you agree to these terms; if you don’t agree, don’t use them. You must be old enough to enter into a contract where you live, or have a parent or guardian agree to these terms for you.
Who we are
Yonto (杨桃) is made by Jasper Kang, a sole trader in New Zealand. “We” and “us” in these terms mean him. You can reach us at support@yonto.app.
What Yonto is
Yonto is a video player for Android TV, Android phones and tablets, and iPhone. It plays from sources you add: your own media servers, and plugins and repos you choose. Yonto provides, hosts and links to no content. Apart from a small demo library of films the Blender Foundation released under Creative Commons licences (credits), everything you watch in Yonto comes from a source you added, and we have no knowledge of or control over it.
You must follow the law
You use Yonto, and everything you add to it, at your own discretion and your own risk. You alone are responsible for:
- making sure you have the right to access and watch everything you play, under the copyright and other laws that apply to you where you live and where the content comes from;
- the sources, plugins and repos you add, and the servers and services they connect to;
- complying with the terms of any service you connect Yonto to.
We don’t monitor what you add or watch, and we have no duty to. Don’t use Yonto in any country or way in which it, or what you do with it, is unlawful.
Third-party plugins, repos and sources
Plugins, repos and sources that we don’t bundle with Yonto are made and run by third parties, not by us. This includes any plugin listed in a repo, offered on another website, or suggested by anyone.
- We don’t write, review, host, endorse or control them, and we make no promise about what they do, what they show, whether they are lawful where you are, or whether they will keep working.
- Installing one is your choice. Before you do, satisfy yourself that it, and the service it reaches, is lawful for you to use.
- Your use of a third party’s service is governed by that third party’s terms, and any dispute about it is between you and them.
- Yonto runs each plugin in a sandbox that can reach only the hosts it declares, which limits but cannot remove the risk of installing code written by someone else.
To the extent the law allows, we are not responsible for any third-party plugin, repo, source or service, or for any loss or claim arising from your use of one.
The plugins bundled with Yonto (for Jellyfin, Plex and Emby, and the MacCMS and XPTV formats) only read the formats those servers use; they connect only to the servers you, or a repo you add, point them at, and what those servers hold is your responsibility. Jellyfin, Plex and Emby are trademarks of their owners. Yonto is not affiliated with or endorsed by them, or by any source you add.
What you may not do
- Use Yonto to infringe anyone’s copyright or other rights, or for anything unlawful.
- Get around, or help others get around, the licence check or the free plan’s limits, or reverse engineer Yonto to do so, except as far as the law permits it.
- Sell, rent or redistribute Yonto, Pro, or licence keys.
- Attack, overload or probe our servers, or use them in any way other than through Yonto and our websites.
- Present Yonto, or anything you make for it, as endorsed by us.
Free and Pro
Yonto is free to use with the demo library and one source of your own. Yonto Pro is a one-time purchase that unlocks more, as described on the pricing page. When you buy Pro you get a licence key by email, which you enter in the app to turn Pro on. Pro is a licence to use features of the app; it includes no content and no access to any third-party service.
Your licence is personal to you and your household, and non-transferable:
- It works on every Yonto app, on up to 5 devices at a time; your account page shows the limit and lets you remove a device to make room.
- Don’t share, publish or resell your key. A key that is shared widely may be revoked.
- Pro is checked on your device and keeps working offline. Yonto checks in with our licence service from time to time, and a device that cannot reach it keeps Pro.
We may add features to Pro, and change what a new purchase includes. We won’t remove a Pro feature you bought, unless the law, a court, an app store or a security problem requires it.
Buying
Our order process is run by our online reseller Paddle.com, who is the merchant of record for all our orders. Paddle handles payment, sales tax, invoices and payment-related customer service, and its buyer terms apply to the purchase. We never see your card.
Refunds
You can get a refund within 7 days of buying, for any reason. The refund policy has the details, and what happens to Pro afterwards.
Suspending and ending
You can stop using Yonto at any time. We may suspend or revoke a licence, or refuse service, if you breach these terms or use Yonto unlawfully, or if the law requires it. If we do, we will tell you why by email, unless the law stops us. A licence revoked for a breach is not refunded, except where the law says otherwise.
Our services
We try to keep the licence service and the websites available, but we can’t promise they will never be down. Pro does not depend on them being up, since it keeps working offline. We may change, suspend or stop parts of the free app, the websites or the services. If we ever stop running the licence service, we will try to release an update that keeps Pro working without it first.
Complaints about content
We host no content, so we can’t remove anything from a source you or anyone else added. If you believe Yonto or something we control, such as our websites or a plugin we bundle, infringes your rights, write to support@yonto.app with the details, and we will look into it.
Warranty and liability
Nothing in these terms limits rights you have under consumer law that can’t be excluded, including the New Zealand Consumer Guarantees Act 1993 and Fair Trading Act 1986 when you buy as a consumer.
Otherwise, and as far as the law allows:
- Yonto, our websites and our services are provided as they are and as available, without any warranty, express or implied, including that they will play any source, work on any device, be free of bugs, or suit any purpose.
- We are not liable for any indirect or consequential loss, for loss of data, profits or use, or for any loss caused by a source, plugin, repo or service you added or connected to.
- Our total liability to you for anything arising from Yonto or these terms is limited to the greater of what you paid us for Pro and NZ$50.
If you use Yonto for a business, you agree that the Consumer Guarantees Act 1993 and sections 9, 12A, 13 and 14(1) of the Fair Trading Act 1986 do not apply, and that this is fair and reasonable.
Your responsibility to us
As far as the law allows, you will cover our losses and costs, including reasonable legal costs, from any claim by someone else that arises from what you added to or watched in Yonto, or from your breach of these terms or of the law.
Changes to these terms
We may update these terms. The date at the top says when they last changed, and if a change affects what you bought, we will email you before it takes effect. Continuing to use Yonto after a change means you accept it.
Law
These terms are governed by the law of New Zealand, and the courts of New Zealand can hear any dispute about them. If you live elsewhere, you also keep the protections of the consumer law where you live.
General
- These terms, the refund policy and the privacy policy are the whole agreement between you and us about Yonto.
- If a court finds part of these terms unenforceable, the rest still applies.
- If we don’t enforce a term straight away, we can still enforce it later.
- You can’t transfer your rights under these terms. We may transfer ours to someone who takes over Yonto, and they will be bound by these terms.
